The agreement

Terms of Service

Version 2026-07-06

These terms are an agreement between you and Weeks Ahead ("Workgrain," "we") governing your use of the Workgrain assessment and related services. By ticking the sign-up checkbox or using the service, you agree to them. If you are accepting on behalf of a company, you confirm you have authority to bind it, and "you" includes that company.

1. What Workgrain is — and is not

Workgrain is a development and team-fit tool: a self-reported read on how a person tends to work and think, with AI-written narrative built on deterministic scoring. It is not a medical, clinical, or psychological diagnostic device; it does not measure intelligence, ability, or aptitude; and its scores are relative to this instrument and its evolving norm sample. It is offered for people 18 and older in workplace contexts.

2. Use of results in employment contexts

In plain language first: a Workgrain result may inform how you understand and work with someone. It must never be the decision about them.

Permitted use. Workgrain results reflect self-reported work-style preferences and are not validated predictors of job performance. You may consider results only as one non-determinative input among multiple sources of information (such as interviews, experience, skills, and references), evaluated by a human decision-maker.

Prohibited use. You shall not (a) use results as the sole or primary basis for any decision to hire, promote, demote, compensate, discipline, or terminate any individual; (b) apply any cutoff score, pass/fail threshold, or automated screening, ranking, or comparison of candidates based on results; or (c) use results in any manner prohibited by applicable law.

Your responsibility. You are solely responsible for your employment decisions and for compliance with all applicable employment and anti-discrimination laws in your use of results — including, where applicable, adverse-impact monitoring, bias-audit, notice, and automated-decision-system requirements (for example, NYC Local Law 144 and the California FEHA automated-decision regulations). Workgrain provides no features that score, rank, screen, or recommend candidates, and nothing in the service constitutes a hiring recommendation.

3. Your account and data

You must give accurate identity information (first and last name, email). You are responsible for your account credentials. Our Privacy & Consent notice — which explains what we collect, how AI processing works, who can see results, and your access/deletion rights — is part of these terms.

If you administer a company on Workgrain, you confirm you have a lawful basis to invite people to take the assessment and to view their results, you will tell them how results will be used, and you will honor the use restrictions in Section 2 within your organization.

4. AI-generated content

The written review, report, coaching, and team analyses are generated by a large language model from your computed scores. They are interpretations, not facts or measurements; they can be imperfect or incomplete; and they describe self-reported tendencies, not the person. Do not treat AI-written narrative as professional, legal, medical, or psychological advice.

5. Intellectual property

The instrument, items, scoring, visuals, and software are ours. You get a limited, non-exclusive, non-transferable right to use the service. You keep ownership of your data; you grant us a license to process it to provide the service and to improve and calibrate the instrument (including anonymized/aggregated norming). You may not copy the items, build a competing instrument from them, scrape, or resell access.

6. Acceptable use

No unlawful use; no taking the assessment as someone else or coercing manipulation of results; no attempting to re-identify anonymized data; no probing, overloading, or reverse engineering the service; no use on or by anyone under 18.

7. Fees

Current pricing, if any, is stated at purchase. Paid features are billed as described at checkout. Because results are digital goods consumed on delivery, completed assessments and generated reports are non-refundable once produced; we will refund purchases that failed to deliver.

8. Disclaimers and limitation of liability

The service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose. To the maximum extent permitted by law, our total liability for any claims arising out of or relating to the service is capped at the amounts you paid us in the twelve months before the claim (or $100 if you paid nothing), and we are not liable for indirect, incidental, special, consequential, or exemplary damages, including employment-related claims arising from a use of results that Section 2 prohibits.

9. Indemnity

If you use results in a way Section 2 prohibits and a claim results, you will defend and indemnify us against that claim.

10. Termination and changes

You can stop using the service and request deletion at any time (see the Privacy notice). We may suspend accounts that violate these terms. We may update these terms; material changes will be versioned (see the version above) and presented for acceptance where required. Continued use after notice constitutes acceptance.

11. Governing law

These terms are governed by the laws of the State of Texas, without regard to conflicts of law. Venue for disputes is the state or federal courts of Texas, and each party consents to their jurisdiction.
